H.O.E. Gardens – Terms & Conditions
(Please read before you click check-out, as these are the terms you are agreeing to when you check the box)

Welcome to Heaven On Earth Gardens (“H.O.E. Gardens,” “we,” “us,” or “our”). We’re so glad you’re here. Below are the details to help ensure a smooth experience for both of us. By placing an order on our website, you agree to the following Terms & Conditions. If you don’t agree—no hard feelings—but please do not place an order.

Yes, this is the fine print. Yes, it matters.


Placing an Order

We sell living plant material, primarily dahlia tubers and rooted cuttings. By purchasing, you acknowledge and agree to the following:

  • All orders are first come, first served.
  • Orders are not guaranteed until payment is completed.
  • We reserve the right to limit quantities, cancel duplicate or suspicious orders, or cancel orders placed using bots, scripts, or other shenanigans.
  • Once an order is completed, we will not change the ship to address and we will not split orders.  We can cancel your order, with a $15USD fee.  Then you can try ordering again with the correct address.

If your order, or combination of orders is canceled for any of the above reasons, you’ll be refunded promptly, less at $15 cancelation fee.

We sell dahlia tubers. Tubers are planted below the soil line and are not decorative items. We do not grade tubers by size, shape, symmetry, or “sex appeal.”  We store our tubers in vermiculite and in an unheated garage - we do not "wake" our tubers before a sale.  They are shipped dormant, unless we have a mild winter and they wake early on their own.

This means:

  • Some tubers are pot tubers or grown from last year’s cuttings
  • Some tubers may be small, oddly shaped, forked, scarred, or misshapen
  • Some tubers may show cosmetic damage from gophers, moles, voles, insects, or general underground life
  • Ugly does not mean unviable

What we do guarantee:

  • Every tuber sold has an eye (could be dormant), or at least one active sprout
  • Every tuber sold is viable and capable of producing a healthy plant
  • We recommend using the baggie method for waking tubers - if you want them awake prior to planting.

What we do not guarantee:

  • Cosmetic appearance
  • Uniformity
  • Size, symmetry, or aesthetic appeal
  • Instagram-worthy tuber photos

If the appearance of the tuber itself matters to you, or if you expect uniform, showroom-quality tubers, we may not be the right fit for you, and we encourage you to purchase elsewhere -- no hard feelings.

We grow for garden performance, not underground beauty contests.

Rooted Cuttings:

All rooted cuttings are intentionally topped (pinched) prior to shipping.

This is not us “stealing a cutting,” shorting your plant, or doing anything shady.

We top all cuttings:

  • To fit safely under greenhouse lights
  • To fit properly in shipping boxes
  • To promote stronger, bushier plants and increased vigor

Pinching is a standard horticultural practice and results in better branching and healthier plants once established.

By purchasing rooted cuttings from us, you acknowledge and accept that:

  • Cuttings will arrive topped
  • A pinched top is intentional and beneficial
  • This is how we grow and ship all rooted cuttings

If receiving a topped or pinched cutting is unwanted, or if you expect a tall, unpinched plant, please do not purchase rooted cuttings from us.

NOTE:  Removing the rooting cube (AKA Root Riot) will void all warranty.  This can harm the roots and we are not responsible for your damage.


Natural Variation Disclaimer

Because these are living plants:

  • Growth, bloom size, color variation, and vigor depend on weather, soil, care, and growing conditions
  • No two plants are identical
  • Results will vary

Plants are not manufactured goods, and perfection is not promised.


Order Minimums and Limits

Minimum Purchase Requirement
May 1st sale:
A minimum total of 3 tubers is required per customer.

You may purchase:
• 3 tubers in one order
or
• 1 tuber per order across 3 separate orders

As long as your combined total equals at least 3 tubers, you meet the minimum requirement.

Orders that do not meet the 3-tuber minimum will be canceled and refunded with a $15USD Policy Violation and Restock Fee.

May-Day Sale:
NO MINIMUMS & NO MAXIMUMS!

Shipping Structure
Shipping is charged on your first order only.
All additional orders automatically receive free shipping.

We have automated this system so you are not charged shipping multiple times and then required to request refunds. This allows you to check out quickly without worrying about repeated shipping fees.

Per-Variety Limit
Maximum of 5 tubers per variety.

Store Access
If the store is closed or password-protected, it is not open for shopping. Orders placed through bypass methods will be canceled.


Discounts & Codes

  • Automatic Discounts (U.S. only):
    • $250+ = Free Shipping
    • $500+ = Free Shipping + 10% off
    • $1000+ = Free Shipping + 15% off
    • CombineShipping = AUTOMATIC combining multiple orders
  • Coupon Codes:
    • LocalPU: Free local pickup (no shipping)
    • LCDS15: 15% off for Lane County Dahlia Society members (verified)
    • HOE_SHOW_2026:  10% off all future orders in 2027 (eligibility required)

Shipping & Timing

  • Shipping occurs only when conditions are safe for the plants.
  • Shipping windows are estimated, not guaranteed.
  • We are not responsible for carrier delays once packages leave our hands.

We reserve the right to delay shipping due to weather, temperature extremes, crop readiness, carrier disruptions, or other factors beyond our control.

  • Tubers:
    • $20 (unlimited tubers)
    • $0.00 for each additional order (between 2/27/2026 and 4/01/2026)
    • Shipping begins March 22 - April 15th (March Sale), or the weekend after (May Sale) until complete.
    • Early shipping by request (Prior to ordering) voids our guarantee due to storage risks.
    • Flat Rates:
  • Rooted Cuttings:
    • We do not ship cuttings from our June in-person sale.
    • Risky to ship—refunds only within 3 days of delivery, with photos.
    • No refund on shipping cost for cuttings – You will help share the risk associated with shipping cuttings.
  • Local Pickup:
    • Use code LocalPU at checkout to waive shipping.
    • Notify us by email for pickup planning.
  • International:
    • Tubers only (no cuttings).
    • 3 tuber minimum, 5 per variety max. (mix and match okay)
    • Ships in a medium sized box, so that all the customs documentation can be affixed to the outside of the box - this is required.
    • Shipping starts late March.
    • Canada: ~$70 USD | Other Countries: ~$100 USD
    • Additional fees for phytosanitary certificates apply.
    • Orders returned to us, for any reason (like "UNCLAIMED" or "DUTIES or TARIFFS unpaid) are non-refundable - we did our part, you did not do yours.

Once It Leaves Our Farm

Once a package is marked Delivered by the carrier:

  • Responsibility transfers to the customer
  • We are not responsible for lost, stolen, or delayed packages
  • Heat, cold, and porch pirates are outside our control

Please track your shipment and retrieve it promptly.


  • Healthy Arrival: Tubers and cuttings should arrive healthy and true to variety.
  • Virus Testing: While we can’t guarantee virus-free plants, we rigorously test and only sell strong performers.
  • Gall: We inspect thoroughly. Contact us with photos if something looks off.
  • Broken or Blind Tubers: Report issues within 1 week of delivery.
  • Failure to Sprout: Let us know by August 1 - refunds only.  An email with pictures is required.  We will not discuss issues over any social media platforms.
  • Mismarked Variety: Report with photo by October 1 via email only.

What We Don’t Guarantee

  • Buyer handling errors (storage, watering, early planting, etc.)
  • Performance after delivery
  • “Waking” tubers with the crown left exposed = voided warranty
  • Issues reported after 1 week of delivery

We cannot guarantee plant performance, bloom size, color variation, or vigor, as these depend on climate, soil, weather, and care.


Unverified Varieties

Unverified Varieties are any varieties on our website marked with a photo that states: “Photo Coming Soon.”

We guarantee that all varieties we sell are true to name. However, unverified varieties are handled slightly differently if a discrepancy occurs.

If an unverified variety blooms incorrectly, the customer must email us a clear photo of the bloom so we can attempt to help identify it. Once reviewed, we will issue an in-store credit for the following year equal to the purchase price of the incorrect variety.

We do not issue refunds for unverified varieties. This policy helps offset the significant processing, platform, and transaction fees associated with each sale and refund. Every transaction carries a cost. In exchange for this shared risk, we price unverified varieties accordingly.

We make every effort to verify and photograph all varieties we grow. We take thousands of photos each season; however, despite our best efforts, we do not always capture, edit, and label every variety before sale.

By purchasing an unverified variety, you acknowledge and agree to these terms.


Promotional Gear

We use a third-party vender to print and ship our promotional gear.  There is a $4.75 S&H fee that is separate from our tuber/cutting sales.  Shipping is 2-3 day USPS, but that does not mean you will have the product(s) in 2-3 days.  That is 2-3 days from printing.  As a rule of thumb, you should expect the merchandise to deliver withing 30 days of ordering.  Sorry, no refunds, returns, or cancelations for these products, as they are printed to order.


Cancellations and Returns

  • All sales are final
  • No returns are accepted
  • You may cancel before shipping, but a $15 fee will be charged to cover transaction costs
  • No fee if we cancel due to crop failure
  • Refunds are case-by-case and must be requested promptly with photos send to us via email within the appropriate time limits set here.

Force Majeure (Things Beyond Our Control)

We are not liable for delays, losses, or cancellations caused by events beyond our control, including but not limited to:

  • Natural disasters
  • Extreme weather events
  • Wildfires, floods, freezes, or heatwaves
  • Pandemics
  • Government restrictions or quarantines
  • Carrier disruptions
  • Acts of God

If this occurs, we will communicate clearly and act reasonably.

Customer Responsibility

By purchasing, you agree that:

  • You understand basic storage, planting, and care requirements
  • You will plant tubers promptly and appropriately
  • Gardening outcomes are your responsibility once plants are in your care

We are not responsible for failures due to improper handling, experimentation, wildlife, pets, or environmental conditions.


Age Requirement

By placing an order, you confirm that you are at least 18 years old or legally able to enter into a binding contract.


Website Content & Intellectual Property

All content on this website -- including photos, descriptions, graphics, and logos -- is the property of Heaven On Earth Gardens.

Content may not be copied, reused, scraped, or redistributed without written permission.


Fairness & Integrity

  • Bots or unfair shopping tactics = order cancellation + a $15 restocking fee
  • Exploiting website vulnerabilities = canceled order and account restrictions
  • Circumventing order limits
  • Acting in bad faith
  • These are just flowers -- let’s keep things kind and fair

Disputes & Governing Law

If an issue arises:

  • Please contact us first-we aim to resolve concerns calmly and fairly
  • If unresolved, disputes will be governed by the laws of the state in which Heaven On Earth Gardens operates, Oregon
  • Eligible claims will be handled through appropriate small-claims procedures

  • Please contact us via email (HeavensDahlias@gmail.com) with any questions or concerns.  Please include photos from time of deliver as well as what they look like now.  This will help speed up a reply.
  • Do not use social media or messenger to contact us.
  • Do not call us using Facebook Messenger.
  • Do not use WhatsApp.
  • Do not call or text us – we are a small farm and I have a real job.  I will reply to emails within 48 hours, usually, sooner.

Final Acknowledgment

By completing your purchase, you confirm that:

  • You have read and understand these Terms & Conditions
  • You agree to them in full
  • You understand that tubers may be cosmetically imperfect but viable
  • You understand that rooted cuttings are intentionally topped prior to shipping
  • Not reading these terms does not exempt you from them Thank you for supporting our small farm. We grow with care—and we’re honored to share that with you
